INDEMNIFICATION AND RELEASE OF LIABILITYIn exchange for the landlord allowing me to voluntarilyUtilize the pool, I understand and agree to:ASSUME AND ACCEPT ALL RISKS arising out of,Associated with or related to my and the Pool Area Users'Use of the pool, even though such risks may have beenCaused by the negligence of the Landlord;2.BE SOLELY RESPONSIBLE FOR ANY INJURY, LOSS ORDAMAGE which I and the Pool Area Users may sustainwhile using the pool, even though such injury, damage,loss or death may have been caused by the negligence ofthe Landlord;INDEMNIFY AND HOLD HARMLESS Landlord from anyAnd all claims, demands, actions, liability or costs,Including attorneys' fees, which might arise out of my orThe Pool Area Users' use of the pool, even though suchClaims, demands, actions and costs may have beenCaused by the negligence of the Landlord.a) has the effect of releasing, discharging, waiving, andforever relinquishing any and all actions or causes ofaction that I may have or have had, whether past,present or future, whether known or unknown, and,whether anticipated or unanticipated by me, arisingout of my or the Pool Users' use of the pool;b) constitutes a complete release, discharge and waiverof any and all actions or causes of action againstLandlord;c) applies to personal injury, property damage, orwrongful death which I and the Pool Area Users maysuffer, even if caused by the negligent acts oromissions of others;d) is an affirmative representation that I am assumingfull responsibility for any and all risk of death oror personal injury or property damage suffered by meand the Pool Users while utilizing the pool; ande) is binding on me, my spouse, my heirs, my personalrepresentatives, my assigns, my children and anyGuardian ad litem for said children.I. ACKNOWLEDGEMENTI acknowledge that by using the pool I have read thisWaiver & Release and that I understand the words andlanguage in it. I further understand that this waiver &Release is intended to be broad and inclusive andGoverned by the laws of the state of California, and iagree that if any portion is held invalid, the remainderof the Waiver & Release will continue in full legal forceand effect.
